2. Scope and definitions
2.1. These Terms and Conditions (the "Terms") apply to orders placed through the webshop operated by the Service Provider and to sales contracts concluded on the basis of those orders. 2.2. "Customer" means any natural or legal person using the webshop and/or placing an order. "Consumer" means a natural person acting outside their trade, independent profession or business activity. "Business / Professional Customer" means a person acting in the course of an economic or professional activity. 2.3. The webshop may primarily offer permanent make-up (PMU) pigments, pigmentation machines, needle modules, single-use and hygiene accessories, pre-drawing and work supplies, aftercare products and related professional products. 2.4. By finalising an order, the Customer declares that they have read and accepted these Terms before placing the order. These Terms do not derogate from mandatory consumer-protection provisions to the detriment of the Consumer.3. Products, professional use and product safety
- The essential characteristics, pack size, composition, colour/shade, intended purpose and, where relevant, restrictions on use are stated on the product page, the manufacturer's label and the packaging.
- PMU pigments and certain devices may be intended for professional use. Where the manufacturer's labelling or applicable law requires a professional qualification, training or permit, the Customer is responsible for ensuring that such requirements are met and that use is lawful in their own country.
- The Customer must use the product in accordance with the manufacturer's instructions on use, storage, hygiene and safety. For pigments, particular attention must be paid to the expiry date, LOT/batch identifier, integrity of the seal/package, storage temperature and light-protection requirements specified by the manufacturer.
- The pigment shade shown on a monitor, phone or other display may differ slightly from the physical product because of display settings. This does not affect the Customer's rights if the delivered product otherwise fails to conform to the characteristics agreed in the contract or stated on the label.
- In the event of a safety recall, manufacturer warning or authority measure, the Service Provider may contact the Customer and request suspension of further use, return of the product or other necessary action.
- The relevant REACH restrictions and applicable labelling and safety rules apply to the placing on the market and use of PMU pigments within the EU/EEA. The Service Provider may only offer products whose marketing within the EU/EEA is lawful.
4. Ordering and conclusion of the contract
- The Customer places the product in the cart and selects the quantity and, where applicable, the product variation.
- The Customer provides billing, shipping and contact details and selects the shipping and payment method.
- Before finalising the order, the Customer can review and correct data-entry errors.
- The order is submitted by pressing the "Place order / Order with obligation to pay" button or another button with equivalent clear wording.
- The webshop automatically confirms receipt of the order by email. This automatic confirmation alone does not constitute acceptance of the order unless the email expressly states otherwise.
- The contract is concluded when the Service Provider separately confirms acceptance or, in the absence of such separate confirmation, when the Customer is notified that performance/dispatch of the order has begun.
5. Prices, VAT and incorrect prices
- Unless otherwise stated, consumer prices shown in the webshop are gross prices. Shipping, cash-on-delivery and other ancillary charges are displayed separately before the order is finalised.
- For cross-border EU sales, the applicable tax rate may depend on the Customer's status (consumer/business), the destination country and applicable tax rules. The final amount payable is shown at checkout before the order is submitted.
- In the event of an obviously incorrect price resulting from a technical or typographical error (for example HUF 0 or a manifestly unrealistic price), the Service Provider may cancel the order before performance begins and offer the product at the correct price. Any amount already paid will be refunded without undue delay.
6. Payment methods
Payment methods available in the webshop: [bank card / Stripe / PayPal / bank transfer / cash on delivery / other]- For online card payments, payment data is processed by the payment service provider; the Service Provider does not receive the full card details.
- For bank transfers, unless the webshop states otherwise, performance of the order begins after the full purchase price has been credited.
- If payment fails or is declined, the order is not considered paid. The Service Provider may cancel the order after the payment deadline has expired without successful payment.
7. Shipping, performance time and receipt
Shipping territory: [Hungary / Germany / EU Member States / other] Courier and delivery partners: [DPD / GLS / Hungarian Post / DHL / other]- Current shipping charges and expected delivery times are shown on the "Shipping & Payment" page and/or at checkout. The Customer can see the full shipping cost before submitting the order.
- Delivery times shown on a product page or at checkout are indicative unless the Service Provider expressly guarantees a deadline. In the event of stock shortage or unforeseen logistics difficulties, the Service Provider will inform the Customer without undue delay.
- If the Service Provider cannot fulfil the ordered product, the Customer will be informed and any amount already paid for that product will be refunded without undue delay.
- For Consumers, the risk passes when the Consumer or a third party designated by the Consumer, other than the carrier, takes physical possession of the goods, unless the carrier was commissioned by the Consumer independently and was not offered by the Service Provider.
- The Customer is advised to report external damage to the package to the courier at the time of receipt and, where possible, to record or photograph the damage. For Consumers, failure to do so does not in itself extinguish statutory warranty rights.
- If a parcel is returned because it was not collected or because the Customer provided an incorrect address, the Service Provider may, within the limits of applicable law, claim the direct costs actually and demonstrably incurred as a result of the Customer's fault.
8. Consumer right of withdrawal - 14 days
- As a general rule, a Consumer entering into a distance sales contract has the right to withdraw without giving reasons within 14 days.
- The 14-day period begins on the day on which the Consumer or a third party designated by the Consumer, other than the carrier, takes possession of the product. If several products are delivered separately, the period begins when the last product is received.
- The Consumer may notify the Service Provider of withdrawal by a clear statement sent by email or post. The model form at the end of these Terms may be used but is not mandatory.
- Following withdrawal, the Consumer must return the product without undue delay and no later than 14 days after notifying the withdrawal. The direct cost of return is borne by the Consumer unless the Service Provider expressly agrees otherwise.
- The Service Provider refunds the amounts paid by the Consumer, including the cost of the least expensive standard delivery method, no later than 14 days after becoming aware of the withdrawal. The refund may be withheld until the goods are returned or the Consumer provides evidence of return.
- The Consumer is responsible for any diminished value resulting from handling beyond what is necessary to establish the nature, characteristics and functioning of the goods.
8/A. Exclusion of the right of withdrawal for hygiene and sealed products
The right of withdrawal cannot be exercised for sealed goods that are not suitable for return for health-protection or hygiene reasons once unsealed after delivery, where the Consumer has broken the seal.- This may include, only where the specific product and packaging meet the statutory conditions, sterile or hygienically sealed needle modules, single-use items that come into contact with the skin, and certain sealed PMU pigments or aftercare products.
- The Service Provider may not apply a general "pigments cannot be returned" rule to unopened products for which the statutory exception does not apply.
9. Statutory warranty for defects, product warranty and guarantee
- In the event of defective performance, Consumers have the statutory warranty rights provided by the Hungarian Civil Code and the rules applicable to consumer sales. As a general rule, consumer warranty claims expire two years after performance.
- For consumer sales of goods, a defect discovered within one year of delivery is presumed, unless proven otherwise, to have existed at the time of delivery, except where that presumption is incompatible with the nature of the goods or the nature of the defect.
- The Consumer may primarily request repair or replacement under the applicable statutory conditions. In specified cases, the Consumer may also be entitled to a price reduction or termination of the contract. The detailed order and conditions of these remedies are governed by the law in force at the relevant time.
- For new durable consumer goods subject to mandatory guarantee under Hungarian law, the applicable guarantee period is determined by the rules in force. At present, where the sales price is at least HUF 10,000 but does not exceed HUF 250,000, the period is 2 years; above HUF 250,000 it is 3 years, provided that the product falls within the material scope of the mandatory guarantee rules.
- The manufacturer or the Service Provider may provide a voluntary commercial guarantee in addition to statutory rights. Its conditions are set out on the product page, guarantee certificate or manufacturer documentation.
- Business / Professional Customers are not entitled to consumer withdrawal rights or consumer guarantees; their rights are governed by the Hungarian Civil Code, the relevant contract and any applicable manufacturer warranty.
10. Complaints and complaint handling
Complaint contact: [EMAIL] | [POSTAL ADDRESS] | [PHONE]- Oral complaints are examined immediately where possible and remedied as appropriate.
- Written complaints are answered in writing, substantively and in a verifiable manner within no more than 30 days after receipt. Any rejection of a complaint will be reasoned.
- For complaint handling, the Service Provider may request the order number, invoice, product photographs, LOT/batch number, expiry date, description of the defect and photographs showing the condition of the packaging, where these are necessary to assess the claim.
- For a health- or safety-related product complaint, the Service Provider may request immediate suspension of further use and may investigate the matter in cooperation with the manufacturer/importer.
11. Consumer protection, enforcement and dispute resolution
- If a complaint cannot be resolved, a Consumer may turn to a consumer-protection authority, a conciliation body or a court.
- Conciliation bodies are free and independent alternative dispute-resolution forums. Since 2024, Hungary has operated 8 regional conciliation bodies; contact details for the body competent according to the Consumer's residence or place of stay are available in the current information published by the Hungarian Chamber of Commerce and Industry.
- The Service Provider complies with its statutory duty to cooperate in conciliation proceedings.
- The former European Commission Online Dispute Resolution (ODR) platform ceased operation on 20 July 2025; accordingly, these Terms do not refer to the former ODR platform.
12. Customers in Germany and other EU Member States
- As a business established in Hungary, the Service Provider may also sell cross-border. Hungarian law applies to the contract within the limits permitted by the rules on choice of law.
- If the webshop directs its activities to Consumers resident in another EU Member State, for example Germany, the choice of Hungarian law does not deprive the Consumer of mandatory consumer-protection provisions of the law of their habitual residence that cannot be excluded by agreement.
- For a German-language sales interface, publication of a complete, professionally reviewed German version of these Terms is recommended, together with German-language payment, shipping, withdrawal and privacy information.
- The Customer is responsible for complying with local requirements relating to professional use, qualifications and hygiene. This does not affect the Service Provider's obligations concerning product safety, compliance and defective performance.
13. Special terms for Business / Professional Customers
- By placing an order, a Professional Customer declares that they are acting in the course of their economic or professional activity. On the basis of business information entered in the billing details, the Service Provider may treat the purchase as a B2B transaction.
- The 14-day no-reason withdrawal right available to Consumers does not apply to Professional Customers unless the Service Provider voluntarily offers a different return option.
- The Professional Customer must inspect the parcel and products within a reasonable time after receipt and report any recognisable quantity or delivery discrepancy without undue delay.
- The Service Provider is not liable for damage arising from use of professional products contrary to their intended purpose, contrary to manufacturer instructions, unprofessionally or without appropriate hygiene, unless the damage results from unlawful conduct by the Service Provider, defective performance or liability that cannot be excluded under mandatory law.
14. Liability and force majeure
- The Service Provider does not exclude or limit liability where such exclusion or limitation is prohibited by law.
- The Service Provider is not liable for damage resulting from incorrect data provided by the Customer, failure to follow instructions for use, use of expired or improperly stored products, or unauthorised or unprofessional use, to the extent the damage is attributable to those circumstances.
- Force majeure may include events outside the Service Provider's control that could not reasonably have been foreseen or avoided, such as war, epidemic-related measures, widespread carrier shutdowns, natural disasters, or official import/marketing restrictions. In such cases, the Service Provider will inform the Customer without undue delay and will seek to restore performance within a reasonable time.
15. Copyright, trademarks and content
- Texts, own photographs, graphics, logos, educational materials and other webshop content may be protected by copyright or trademark law. Commercial copying, adaptation or republication without the right holder's permission is prohibited.
- Manufacturer logos, product photographs and brand names are the property of their respective rights holders and appear in the webshop for product identification and sales purposes.
16. Data protection
- Detailed rules on the processing of personal data are set out in a separate Privacy Notice. The Customer is informed about processing necessary for the order before the order is finalised.
- Subscription to marketing newsletters may not be a condition of purchase and requires separate, voluntary consent unless another legal basis permits otherwise.
17. Amendment of the Terms
- The Service Provider may amend these Terms for the future, in particular due to changes in law, regulatory practice, services or logistics.
- An amendment does not affect contracts concluded before the amendment takes effect, unless the amendment is required by mandatory law and the law provides otherwise.
- The version of the Terms in force at any time is available in the webshop in a downloadable and saveable format.
18. Applicable law and final provisions
- These Terms and contracts concluded under them are governed by Hungarian law, provided that a Consumer resident in another EU Member State may not be deprived of mandatory consumer-protection provisions of the law of their habitual residence.
- If any provision of these Terms is invalid or unenforceable, this does not affect the validity of the remaining provisions where permitted by law; the relevant mandatory statutory provision applies in place of the invalid provision.
- The parties will primarily seek to resolve disputes amicably. In consumer disputes, these Terms do not restrict the Consumer's statutory rights to judicial or alternative dispute resolution.
